- For A Spouse Currently Living in Canada
- 1 Download the application kit for sponsoring a spouse currently residing in Canada. CIC provides a PDF copy of all forms required for permanent residence in Canada. You can print and file them.
- 2 Fill out all the required forms in the application kit. The application kit contains several forms, including the In-Canada Application for Permanent Residence, the Schedule 1 Background/Declaration, the Application to Sponsor and Undertaking, Sponsorship Agreement, Sponsorship Evaluation, Spouse/Common-Law Partner Questionnaire, Use of a Representative and Medical Report. The instructions for completing each form in the application kit are attached to each form.
- 3 Obtain a fee receipt. If you have a credit card, you can pay your fees online. If you do not have a credit card or do not want to pay online, you can order Form IMM 5401 via mail by calling CIC. After receiving Form IMM 5401, you can pay at any financial institution located in Canada.
- 4 Submit all forms to the Case Processing Centre. The address for mailing your forms is included on Form IMM 5289 of the application kit. After receiving your application, the Case Processing Centre will make a determination as to whether your spouse will be granted permanent residence. You can check on the progress of your spouse's residency application on the CIC website.
- For a Spouse Currently Living Outside Canada
- 5 Download the application kit for sponsoring a spouse currently residing outside Canada. CIC provides a PDF version of all forms required to immigrate to Canada. You may print and file them.
- 6 Fill out all the sponsorship forms. The application kit contains several forms, including the Application to Sponsor and Undertaking, Sponsorship Agreement, Sponsorship Evaluation, Statutory Declaration of Common-Law Union, Sponsor Questionnaire, Use of a Representative and Medical Condition Statement.
- 7 Obtain a fee receipt. If you have a credit card, you can pay your fees online. If you do not have a credit card or do not want to pay online, you can order Form IMM 5401 via mail by calling CIC. After receiving Form IMM 5401, you can pay at any financial institution located in Canada.
- 8 Submit all forms to the Case Processing Centre. The address for mailing your forms is included on Form 3900 of the application kit. After receiving your application, the Case Processing Centre will determine whether your spouse will be granted permanent residence. If your spouse will be granted permanent residence, a copy of all necessary immigration forms for your spouse will be mailed to the Canadian Embassy in the country where your spouse is currently living
- 9 Have the spouse fill out the immigration forms. There are several immigration forms that must be filled out, including an Application for Permanent Residence, a Schedule 1 Background/Declaration, Additional Family Information, Sponsored Spouse/Partner Questionnaire and Use of a Representative. Additionally, your spouse will be required to fill out region-specific forms, depending on where your spouse is currently living. After receiving the immigration forms, the sponsor must send them to the Case Processing Centre, for which the mailing address will be included in the immigration forms. After receiving the immigration forms, the Case Processing Centre will mail a letter requiring the spouse to mail a valid passport to the Case Processing Centre, which will be returned with a valid visa permitting entry to Canada. After receiving a valid visa, the spouse must travel to Canada within the period specified on the visa.
